This website is operated by FishNook Ltd. Throughout the site, the terms “we”, “us” and “our” refer to FishNook Ltd. FishNook Ltd. offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Any cancellation, refund, credit, replacement, or other accommodation we extend is at our sole discretion and does not obligate us to provide the same in any other instance.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

5.1 Product Substitutions and Replacements
For Bundle Products:
- We reserve the right to replace or swap any item within a bundle with a product of similar value and like kind (e.g., one type of sardines may be replaced with another type of sardines) at our discretion.
- We may, but are not obligated to, contact you regarding such replacements.
- If a suitable replacement of like kind and similar value is not available, we may either: (a) provide a refund for that portion of the order, or (b) contact you with alternative replacement options.
For Individual (À La Carte) Orders:
- In the event of stock unavailability after purchase, we reserve the right to: (a) offer a suitable replacement product at our discretion, or (b) process a refund for the unavailable item.
- We may, but are not obligated to, contact you regarding potential replacements.
Advertised, Featured, and Promoted Products:
- Product images, names, descriptions, and other details shown in connection with any bundle, tasting set, curated assortment, subscription, or promotion are illustrative and represent our intended offering at the time of publication. Because much of our catalog is sourced seasonally and subject to limited or variable availability, the specific items advertised as part of any bundle or subscription are not guaranteed.
- We reserve the right, at our sole discretion and without prior notice, to substitute, swap, add, remove, or otherwise change any item advertised or featured as part of a bundle, assortment, or subscription, including items shown in marketing, product pages, or promotional materials. Where we substitute an item, we will use commercially reasonable efforts to provide a product of like kind and of equal or greater value.
General Substitution Terms:
- When we do reach out regarding replacements, if we do not receive a response within a reasonable timeframe, we reserve the right to: (a) ship the order with a replacement product of our choosing, or (b) process a refund for the affected item(s).
- The determination of what constitutes a “reasonable timeframe” shall be at our sole discretion.
- All replacement items will be of equal or greater value to the original item.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
5.2 Shipping and Address Accuracy
You are solely responsible for providing and maintaining a complete and accurate shipping address and recipient information for every order, including one-time (à la carte) orders and all recurring subscription orders. This responsibility applies to each subscription renewal: it is your responsibility to keep your shipping address current in your account before an order is fulfilled.
We are not responsible or liable for orders that are delayed, misdelivered, returned, lost, or rendered unrecoverable as a result of an address or recipient detail that you entered incorrectly, incompletely, or failed to update. In such cases we are under no obligation to reship the order or to issue a refund or credit.
As a courtesy, we may, at our sole discretion, attempt to assist in locating or recovering a misdirected order, reship the order, or otherwise accommodate you. Any such assistance is voluntary, is decided case by case, and does not waive this section or obligate us to do the same in any other instance. Where we agree to reship an order that was undeliverable due to customer-provided information, any reshipment may be at your expense, including the cost of replacement product and shipping, at our discretion.
Section 6 - Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

6.1 Fraud Prevention and Order Verification
We take fraud and payment abuse seriously. We use a variety of methods to evaluate the risk associated with orders. If an order is flagged as high risk or if we otherwise suspect fraud, unauthorized payment-method use, or other abuse, we may, at our sole discretion and to the extent permitted by applicable law:
- Place the order on hold and request additional information to verify your identity and authority to use the payment method, which may include government-issued photo identification, confirmation of the billing address, the card or payment instrument used, or other reasonable verifying information;
- Decline, cancel, or refund the order, in whole or in part;
- Limit, suspend, or terminate the associated account; and
- Report suspected fraudulent activity to payment processors, card networks, or law enforcement, and pursue any remedies available to us, including legal action.
If we request verifying information in connection with a suspected high-risk or fraudulent order and you decline to provide it, or do not provide it within a timeframe we consider reasonable, that refusal or non-response is itself grounds for us to cancel the order and, where applicable, suspend or terminate the account, without further obligation to you. We are not liable for any loss or inconvenience arising from a hold, cancellation, or verification request made under this section.
Section 7 - Optional Tools and Subscription Services
We may provide you with access to third-party tools and services over which we neither monitor nor have any control nor input, such as account features, our subscription management service, our wholesale ordering service, email and SMS messaging services, customer support tools, affiliate tracking, and analytics tools. You acknowledge and agree that we provide access to such tools and services “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of these optional tools and services.
7.1 Subscription Program Terms
We offer subscription programs through a third-party subscription management service. Our subscription programs include, among others, à la carte “subscribe and save” subscriptions and our curated monthly rotating subscription tiers (for example, our Explorer, Gourmet, and Omakase tiers). The specific programs, tiers, and benefits we offer may change over time as described below.
Eligibility and Discounts:
- Our currently offered subscription provides a 10% discount on qualifying “subscribe and save” orders, billed monthly.
- We have previously offered other subscription frequencies and discount levels that we no longer make available to new subscribers. Customers who enrolled under a prior structure may remain on that structure at our discretion until they cancel or until we modify or discontinue that structure under the terms below. Continued enrollment under a legacy structure does not entitle any other customer to that structure.
- Subscription discounts apply only to eligible products as determined by us and, unless we expressly state otherwise, cannot be combined with other promotional offers.
Billing and Payment:
- Your payment method will be automatically charged on a recurring basis according to your selected subscription frequency and schedule, until you cancel or we terminate or modify the subscription.
- You authorize us and our subscription service provider to store your payment information and to charge your payment method for each recurring order.
- You are responsible for maintaining current and valid payment information. Failed payments may result in subscription suspension or cancellation until resolved.
Managing, Skipping, Pausing, and Cancelling:
- There is no minimum number of orders and no minimum commitment. You may cancel your subscription at any time.
- You may skip, pause, modify (including changing frequency or items where supported), or cancel your subscription at any time before your next order is fulfilled. You generally have the entire period before your next scheduled renewal to make changes. Once an order has been fulfilled, that order can no longer be skipped, modified, or cancelled, and is subject to our Returns & Refunds Policy.
- You can manage your subscription through your online account dashboard or by contacting customer support. We recommend making any changes well in advance of your scheduled renewal date to ensure they take effect for the upcoming order.
Changes to Subscription Programs:
- We reserve the right, at our sole discretion and at any time, to add, modify, restructure, suspend, or discontinue any subscription program or tier, in whole or in part, including our à la carte “subscribe and save” subscriptions and our monthly rotating subscription tiers (such as Explorer, Gourmet, and Omakase). Such changes may include, without limitation, changes to pricing, discount levels, billing frequency, shipping and handling fees, the products or assortments included, tier names and structures, eligibility requirements, and any other features or terms of the programs.
- Where required by applicable law, we will provide notice of material changes to the recurring price of an active subscription before the change takes effect, and you may cancel before the change applies if you do not agree to it. Your continued participation in a subscription after a change takes effect constitutes acceptance of the change.
Product Availability and Substitution within Subscriptions:
- The items featured in any subscription, including the curated selections in our rotating tiers, are subject to seasonal and variable availability. As described in Section 5.1, we reserve the right to substitute, swap, add, or remove items within a subscription order at our discretion, using commercially reasonable efforts to provide products of like kind and of equal or greater value.
Delivery:
- As described in Section 5.2, you are responsible for maintaining accurate delivery information for each recurring order. Failed or misdirected deliveries resulting from inaccurate or out-of-date information you provided are not our responsibility and are handled as set out in Section 5.2.
- We reserve the right to modify delivery schedules due to holidays, weather events, or supply chain disruptions.
General:
- Subscription benefits are non-transferable.
- We may suspend, cancel, or terminate any subscription that violates these Terms, that we reasonably suspect involves fraud or abuse (including the abuse of discounts, promotions, or account structures), or as otherwise permitted under Section 2.

Certain content, products and Services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
Section 9 - User Comments, Feedback and Other Submissions
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “comments”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. In no case shall FishNook Ltd., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. You agree to indemnify, defend and hold harmless FishNook Ltd. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Section 15 - Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
Section 16 - Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
Section 17 - Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Section 18 - Governing Law, Dispute Resolution, and Arbitration
These Terms of Service and any separate agreements whereby we provide you Services, and any dispute or claim arising out of or relating to them, your use of the Services, or any products you purchase from us, shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws rules.
Informal Resolution First. Before initiating any arbitration or other proceeding, you agree to first contact us at hello@shopfishnook.com and provide a brief written description of your claim and your contact information, and to give us at least sixty (60) days to attempt to resolve the dispute informally.
Binding Arbitration. If we cannot resolve a dispute informally, you and FishNook Ltd. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be resolved by final and binding arbitration administered by a nationally recognized arbitration provider under its applicable consumer arbitration rules, rather than in court, except as set out below. The arbitration will be conducted in the English language. Judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver. You and FishNook Ltd. agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Exceptions. Notwithstanding the above, (a) either party may bring an individual claim in small claims court for disputes within that court’s jurisdiction; and (b) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or other proprietary rights. Any claim that proceeds in court shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
Opt-Out. You may opt out of this arbitration agreement and class action waiver by sending written notice to hello@shopfishnook.com within thirty (30) days of first accepting these Terms, stating your name and that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
Survival. This Section survives termination of these Terms and your relationship with us. If any portion of this Section is found unenforceable, the remainder shall be given full effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim shall proceed in court rather than arbitration.

Mobile Terms of Service

The FishNook Ltd. mobile message service (the “Service”) is operated by FishNook Ltd. (“FishNook Ltd.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to FishNook Ltd.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of FishNook Ltd. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with FishNook Ltd. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
